2. Applicability

These General Terms & Conditions apply to offers, orders and agreements concluded through store.taplite.com unless otherwise expressly agreed in writing.

A “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.

A “Business Customer” means a person or organisation acting in the course of a trade, business, craft or profession.

Where mandatory consumer law provides a Consumer with rights that differ from these Terms, those mandatory consumer rights prevail.

3. Products and product information

We aim to describe and display our products as accurately as reasonably possible.

Product photographs, digital visualisations and colours displayed on a screen may differ slightly from the physical product.

Dimensions, technical specifications, materials, compatibility information and other important characteristics are stated on the relevant product page where applicable.

Obvious typographical, pricing or technical errors do not bind Taplite where it should reasonably have been clear that an error had occurred.

If an error materially affects an order already placed, we will contact the customer as soon as reasonably possible and offer an appropriate solution.

4. Prices and taxes

The price applicable to an order is the price shown during the checkout process before the order is submitted.

For sales to Consumers, applicable VAT and mandatory charges will be clearly included or shown before the purchase is completed.

Shipping charges and other applicable costs will be shown before the order is submitted.

For international orders, local import duties, customs charges or taxes may apply depending on the destination and customer status. Where these charges are not collected by Taplite during checkout, they may be payable by the recipient.

5. Orders and conclusion of the agreement

Before submitting an order, the customer has the opportunity to review the products, quantities, prices, delivery information and other order details.

By submitting an order using a button that clearly indicates a payment obligation, the customer makes a binding order.

After receiving the order, we will send an electronic order confirmation.

An order may be refused or cancelled by Taplite where reasonably necessary, for example where:

  • a product is unavailable;
  • there is an obvious pricing or technical error;
  • payment cannot be completed;
  • the requested product cannot reasonably or safely be produced;
  • submitted artwork cannot be lawfully or technically used; or
  • fraud or misuse is reasonably suspected.

If we cancel an order after payment has been received, the amount paid for the cancelled part will be refunded.

6. Payment

Available payment methods are displayed during checkout.

The customer must pay the amount shown at checkout using one of the available payment methods, unless Taplite has separately agreed different payment terms with a Business Customer.

Payment providers may apply their own terms and privacy policies to payment processing.

7. Artwork and customer-supplied materials

For personalised products, the customer is responsible for providing artwork and information of sufficient quality and in a usable format.

Our standard product price includes ordinary placement of customer-supplied, production-ready artwork where stated on the product page.

Additional creative work, logo restoration, vectorisation, substantial corrections or complex layout work is not included unless expressly stated.

Where additional studio or DTP work is required, our standard rate is €75 per hour, with a minimum charge of 15 minutes.

We will inform the customer before carrying out chargeable additional design work.

8. Rights to uploaded artwork

By submitting a logo, design, image, trademark, photograph, text or other material, the customer confirms that they have the necessary rights and permissions for Taplite to use that material for the requested order.

The customer grants Taplite the limited right to reproduce, adapt and process the submitted material to the extent reasonably necessary to prepare, manufacture and deliver the ordered products.

The customer remains the owner of any rights they already hold in the submitted artwork.

Taplite may refuse material that reasonably appears to infringe third-party intellectual property rights or applicable law.

Business Customers are responsible for claims resulting from artwork supplied by them where they did not have the necessary rights to use that artwork.

This clause does not limit rights that cannot lawfully be excluded.

9. AI-generated artwork

AI-generated images may contain visual artefacts, inconsistent details or unsuitable production data and may not be directly usable for printing, engraving or other production methods.

Taplite may therefore require replacement or professionally prepared production artwork before manufacture.

If the customer asks Taplite to redraw, correct or convert AI-generated artwork into suitable production artwork, additional studio or DTP charges may apply. We will inform the customer before chargeable work begins.

10. Proofs and approval

Where Taplite supplies a digital proof or artwork approval before production, the customer is responsible for checking the information shown, including spelling, dimensions, orientation, colours, layout and logo placement.

Production may begin after approval.

Minor differences between a screen proof and the final physical product may occur because screens and physical printing or manufacturing processes reproduce colours and materials differently.

Approval does not remove a Consumer’s statutory rights where the delivered product is defective or does not conform to the agreement.

11. Personalised and custom-made products

Products made according to the customer’s specifications or clearly personalised may be produced specifically for that customer and may not be suitable for resale.

Consumers do not have a statutory right of withdrawal for such products where the legal exception for custom-made or clearly personalised goods applies.

The relevant exception will be communicated before the order is completed.

This does not affect statutory rights if a personalised product is damaged, defective or does not conform to the agreed specification.

12. Delivery

Available delivery methods, estimated delivery times and shipping costs are shown during checkout or otherwise communicated before the order is concluded.

Delivery times are estimates unless a fixed delivery date has expressly been agreed.

We will inform the customer where we become aware of a material delay.

For Consumers, statutory rules regarding delivery and transfer of risk apply.

For Business Customers, any specific transport or Incoterms arrangements expressly agreed for the order prevail over this section.

13. Customs and international delivery

International orders may be subject to customs procedures, import restrictions, duties and local taxes.

The customer is responsible for providing accurate information required for customs clearance.

Where customs duties or import taxes are not included in the amount collected by Taplite, these charges are normally payable by the recipient or importer.

14. Withdrawal and returns

Consumer withdrawal rights, return instructions, refund conditions and the rules for personalised products are described in our Orders, Returns & Withdrawal Policy.

That policy forms part of these Terms.

The statutory consumer right of withdrawal does not apply to Business Customers.

Any commercial return arrangement for a Business Customer must be agreed with Taplite.

15. Conformity, defects and statutory warranty

Products supplied to Consumers must conform to the agreement and have the characteristics a Consumer may reasonably expect under applicable law.

If a product is defective, damaged or incorrectly supplied, please contact us at sales@taplite.com.

Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, completion of the order, a price reduction or refund.

Any manufacturer’s or commercial warranty is additional to, and does not replace, mandatory statutory consumer rights.

16. Compatibility and intended use

Customers are responsible for checking whether a product is suitable for their intended installation or equipment where compatibility depends on equipment or specifications that have not been supplied to Taplite.

Where Taplite has expressly confirmed compatibility based on information supplied by the customer, the customer may rely on that confirmation subject to the accuracy and completeness of the information provided.

Products must be installed and used in accordance with supplied instructions and safety information.

17. Product safety

Taplite aims to supply products that comply with applicable product safety requirements.

Relevant product identification, manufacturer information, responsible-person information where applicable, and warnings or safety instructions are provided on the product page, packaging or accompanying documentation as required.

Customers must follow any safety and installation instructions supplied with the product.

18. Complaints

Questions and complaints can be submitted to:

sales@taplite.com
+31 (0)20 623 7899

Please include your order number and sufficient information for us to understand the issue.

We aim to acknowledge and deal with complaints within a reasonable period.

Nothing in this section limits any statutory complaint, warranty or enforcement rights available to Consumers.

19. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

For Consumers, Taplite’s liability is subject to applicable mandatory consumer law.

For Business Customers, to the extent permitted by law, Taplite is not liable for indirect or consequential business losses such as loss of profit, loss of turnover, loss of anticipated savings or business interruption, unless caused intentionally or through deliberate recklessness attributable to Taplite’s management.

To the extent permitted by law, Taplite’s aggregate liability towards a Business Customer in relation to an individual order is limited to the amount paid for the relevant order or, where applicable, the amount paid out under Taplite’s applicable liability insurance, except where such limitation is not legally permitted.

20. Force majeure

Taplite is not responsible for a failure or delay in performance caused by circumstances beyond its reasonable control, such as serious transport disruption, natural disasters, war, government measures, power or network failures, strikes, major supplier disruption or other qualifying force majeure events.

We will inform affected customers where reasonably possible.

For Consumers, this section does not restrict mandatory rights relating to delayed or failed delivery.

21. Intellectual property of Taplite

Unless otherwise stated, the website, product photography, text, graphics, Taplite branding, designs and other website content owned by Taplite are protected by intellectual property rights.

They may not be copied, reproduced, commercially exploited or distributed without permission, except where applicable law permits such use.

Third-party logos and trademarks displayed in connection with customer work remain the property of their respective owners.

22. Personal data

Personal data is processed in accordance with our Privacy & Cookie Policy.

23. Changes to these Terms

We may update these Terms from time to time.

The version applicable to an order is the version made available to the customer when that order is placed.

Changes to these Terms do not retrospectively alter an existing agreement unless legally permitted and expressly agreed.

24. Governing law

These Terms and agreements with Taplite are governed by Dutch law.

For Consumers residing in another country, this choice of law does not deprive them of mandatory consumer protection that applies to them under applicable law.

Nothing in these Terms limits a Consumer’s mandatory rights regarding competent courts or dispute resolution.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

The invalid provision will, where legally possible, be interpreted or replaced in a way that most closely reflects its lawful purpose.
